Kilmore Racing Club Conditions of entry

Prohibited Items

The following items are not permitted into the Kilmore Racecourse:
• Liquor or any alcoholic beverages
• Glass bottles or containers
• Animals (except if you are blind, deaf or otherwise have a disability, an animal used for your assistance)
• Laser lights, laser pointers, flares or other explosive or flammable goods or equipment.
• Rollerblades, skateboards or scooters
• Personal BBQs
• Knives or other dangerous weapons

Prohibited Behaviour, Conduct and Activities

You must not, in or around the racecourse engage in the following prohibited behaviour, conduct and activities.
• Use photographic, video or audio recording equipment in areas where such use is prohibited or as otherwise directed by Kilmore Racing Club or its employees, agents or contractors.
• Operate or use a loud hailer, public address system or other broadcast device
• Distribute, hawk, sell, offer or expose for sale any goods or services or collect money or orders from patrons for goods and services, without the prior written consent of Kilmore Racing Club
• Conduct public surveys or opinion polls, solicit money, donations or subscriptions from members of the public, without the written consent of Kilmore Racing Club
• Smoke in areas nominated by Kilmore Racing Club as no-smoking
• Enter the non-public areas of the racecourse, including the physical racetrack, stalls or any area which is restricted to officials, licensed persons and bearers of special ticketing.
• Misuse, deface, damage, remove from the racecourse or tamper with any building, animal or thing
• Post, stick or place any poster, placard, bill, banner, print, paper or any advertising material on any building, structure, fence, tree or cordon without the prior written consent of Kilmore Racing Club
• Distribute any printed or visual matter or distribute, display or promote any advertising or promotional material, samples of goods or services or any other matter or thing, without the prior written consent of Kilmore Racing Club

Liquor Licensing

All persons entering Kilmore Racing Club are advised that:
• They are entering a licensed premises
• Intoxicated persons will not be permitted to enter
• Persons in possession of liquor will not be permitted to enter
• Should any person become intoxicated during the event they will be removed from the premises
• It is an offence for minors to purchase and consume liquor
• It is an offence to purchase liquor for (or supply liquor to) minors

Right to a Refund

Your right to a refund is limited to the cost of an admission ticket, purchased for monetary consideration, when the specified circumstances apply and the required conditions are met. The Club reserves, at all times, the right to exercise its discretion in the payment of any refund amount.

Entitlement to a Refund

An entitlement to a full refund of the amount paid for an admission ticket occurs when all Racing Events scheduled for the particular day at the Course are cancelled prior to completion of the first Racing Event of that day. In such circumstances, your entitlement may be by way of a monetary refund or an admission ticket to the Course on an alternate date as you so elect.

Partial Refund

In the event that Racing Events are cancelled prior to the completion of the Feature Race, the Club may pay you a partial refund of cost of the admission ticket or supply you with an admittance ticket to a future race meeting. The refund amount will be determined at the sole discretion of the Club having due regard to the number of Racing Events completed. If the Feature Race is completed and cancellation is limited to Racing Events following the Feature Race, then no refund will be payable.

In the event of a multiple-day carnival, for which an admission ticket provides access to the Course for more than one day, then the Club will determine the amount of the refund payable, if any.

Exclusions from Refunds

A refund, if any, relates solely to the cost of an admission ticket purchased for monetary consideration. No refund is applies in respect of any fees paid by a Member by way of annual subscription, any expense incurred by you in preparing for the scheduled Racing Events, your travel expenses, the purchase of a Race Book, the purchase of any catering facilities or any expense incurred pursuant to a contract with a third party. Should you decide not to attend, or be unable to attend, the Course on the day for which you purchased the admission ticket, or should leave the Course prior to the completion of all Racing Events for any reason other than the cancellation of Racing Events, then no refund is payable.

Claiming a Refund

An application for a refund must be forwarded to, and received by, the Secretary of the Club within 30 days following the particular day for which the refund is sought. In making application you must be able to evidence the possession of an admission ticket, and provide it. If the admission ticket does not indicate the relevant date on which the particular Racing Events were scheduled, then you must provide, to the Secretary, a completed Statutory Declaration declaring your attendance at the Course on the particular day and the reasons for seeking the refund. The provision of this Refund Policy does not constitute admission of a liability by the Club.
